Jesus Agustin Perez Garcia was arrested during a July 2023 traffic stop when officers discovered methamphetamine paraphernalia and marijuana in his possession. Despite having no prior criminal history, Garcia was sentenced to five years in prison by District Judge Darren B. Simpson, who concluded that Garcia's status as an undocumented immigrant who had previously been deported made probation impossible.

Garcia had pleaded guilty to felony possession of a controlled substance and destruction of evidence after attempting to hide a methamphetamine pipe under a police patrol car during the traffic stop. At his January 2024 sentencing hearing, Judge Simpson acknowledged that Garcia "would typically get probation" based on standard sentencing factors, but expressed concern about how Garcia could comply with probation's requirement to "obey all laws including the federal laws" while residing illegally in the United States.

Writing for a unanimous panel, Justice Robyn Brody Meyer affirmed the sentence, reasoning that Garcia's inability to comply with federal law was a compelling reason to deny probation. As Meyer explained, "where a person is unable to comply with the law, he is also a poor candidate for probation because he is unable to be properly rehabilitated, which defeats the purpose underlying Idaho's probation system."

The court emphasized that Garcia's ongoing presence in the United States constituted a continuing federal crime under 8 U.S.C. § 1326(a), which criminalizes unlawful reentry after deportation.

The Idaho Supreme Court clarified that while "immigration status alone does not render a defendant ineligible for probation," courts may properly consider it "insofar as it bears on the defendant's ability to comply with the ordinary terms of probation."

In a notable procedural development, Garcia was deported while his appeal was pending, according to a letter from his appellate counsel filed on October 2, 2025, the day after oral argument.
