Maria J. Abregu sued Yanira Gonzalez, who owns Master Kitchens Center, alleging their oral contract required Gonzalez to perform various home improvements to Abregu's property at 23 Winterberry Road in Narragansett after it suffered water damage. Abregu alleged that work including portions of an outside deck, an outdoor shower, concrete steps, and electrical and plumbing issues were either completed unsatisfactorily or left unfinished, and sought $3,000 in damages.

Gonzalez disputed the claims, asserting she only agreed to install kitchen countertops. She testified that when she arrived at the property, she found it "was just gutted" and missing flooring and electrical work. According to Gonzalez, Abregu had a budget of $8,000, which was insufficient for the broader work, so Gonzalez suggested her brother might do the work within that price range.

The case proceeded through District Court, where it was dismissed, then to Superior Court on appeal. After a bench trial on August 2, 2024, the trial justice found "more credible the testimony of the defendant in that she was retained for the sole purpose of installing * * * the countertops" and ruled in favor of Gonzalez.

The Rhode Island Supreme Court affirmed on April 13, 2026, holding that the trial justice did not err in rendering judgment for the defendant. The court emphasized its deference to credibility determinations, noting that the trial justice "was in the best position to make such credibility determinations" after observing the parties' testimony and demeanor.
