Judge Cathy Seibel entered judgment in favor of the government on April 8, 2026, after granting the government’s motion for summary judgment in its action to cancel Pizzuti’s Certificate of Naturalization under 8 U.S.C. § 1451. The underlying judgment found that Pizzuti illegally procured his citizenship through concealment of a material fact and willful misrepresentation, revoked the order admitting him to citizenship, cancelled Certificate of Naturalization No. 26724011 effective as of July 24, 2002, and permanently enjoined him from claiming any rights of citizenship based on that naturalization.

Pizzuti applied for a stay of the judgment’s execution on April 16, 2026. The Second Circuit denied his application without prejudice to renewal pending the district court’s ruling on a parallel stay motion. The district court was scheduled to address the application at a compliance hearing set for April 22, 2026.

Pizzuti failed to appear at the April 22 compliance hearing. Nevertheless, Judge Seibel denied his motion to stay on April 24, 2026. However, the court stayed enforcement of the judgment’s findings and orders through Monday, April 27, 2026, to give Pizzuti time to seek relief from the Second Circuit.

The remaining obligations of Pizzuti set forth in the April 8 judgment remain in effect. He must appear in person for a compliance hearing on May 5, 2026, at which he must demonstrate that he has complied with the judgment.

Pizzuti first appeared in the case on November 26, 2025, when he filed a motion to dismiss the government’s complaint. The court denied that motion and granted summary judgment for the government on April 8, 2026. Pizzuti filed a notice of appeal on April 20, 2026.
