SAN FRANCISCO (LN) — U.S. District Judge Susan Illston issued an order on May 15, 2026, staying all further proceedings in the Enovix Corporation securities litigation pending the Ninth Circuit's resolution of the plaintiffs' petition for leave to appeal under Federal Rule of Civil Procedure 23(f).

The stay follows Illston's April 21 order denying the plaintiffs' motion for class certification. The plaintiffs filed a petition asking the Ninth Circuit to review that denial, and they requested a stay of the district court case to prevent further litigation while the appellate court considers their request.

Illston granted the stay after noting that the defendants did not oppose it. The order specifies that the stay will be lifted if the Ninth Circuit denies the petition, or if the petition is granted, after the appeal is resolved.

The parties must submit a joint letter to the court within 14 days of the stay being lifted, updating the court on the status of further proceedings.
