Terms of Use

These Terms of Use govern your access to and use of LitNews.ai, including the website, feeds, newsletters, research pages, article pages, source-document links, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
1. No legal advice; no attorney-client relationship
LitNews.ai is a publication and research service. It is not a law firm and does not provide legal advice. Use of the Service does not create an attorney-client, fiduciary, advisory, or confidential relationship. You are responsible for evaluating the accuracy, completeness, and usefulness of any material on the Service.
2. Source materials control
The Service may summarize, classify, rank, excerpt, quote, or otherwise describe court opinions, orders, complaints, agency actions, transcripts, oral arguments, verdicts, and other public records. Those source materials control over any summary, headline, excerpt, tag, byline, metadata field, or other presentation on the Service.
3. Third-party content; Section 230
The Service may host, cache, index, embed, transmit, link to, excerpt, aggregate, or otherwise make available content supplied by third parties, including public filings, court records, transcripts, source documents, external websites, feeds, and submissions from users or other third parties (“Third-Party Content”). To the fullest extent provided by law, LitNews.ai is not the publisher or speaker of Third-Party Content provided by another information content provider and does not assume responsibility for that content solely because it is stored, indexed, linked, transmitted, recommended, or otherwise made available through the Service. LitNews.ai reserves the right, but not the obligation, to remove, restrict, de-index, or refuse any Third-Party Content at any time.
4. Permitted use
You may use the Service for lawful personal, editorial, journalistic, research, and business purposes. You may not use the Service to violate any law, infringe any person’s rights, interfere with the operation or security of the Service, scrape the Service in a manner that burdens infrastructure or circumvents access controls, or republish substantial portions of the Service as a substitute for LitNews.ai.
5. No warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITNEWS.AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, COMPLETENESS, TIMELINESS, QUIET ENJOYMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITNEWS.AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, OWNERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF LITNEWS.AI FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO LITNEWS.AI, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
7. Indemnity
You agree to defend, indemnify, and hold harmless LitNews.ai and its affiliates, officers, directors, owners, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
8. Arbitration agreement; class action waiver
Please read this section carefully. It affects your rights, including your right to sue in court and to have claims heard by a jury.
Except for claims that qualify for small-claims court, claims seeking only injunctive relief for misuse of intellectual property, or claims that by law cannot be arbitrated, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”). The arbitration will be conducted under the AAA Commercial Arbitration Rules and, where applicable, the AAA Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
Unless the parties agree otherwise, the arbitration will be conducted in San Francisco County, California, or by remote proceedings if permitted by the applicable AAA rules. The arbitrator will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court of competent jurisdiction may decide issues relating to the enforceability of the class action waiver below.
Class action waiver. To the maximum extent permitted by law, you and LitNews.ai agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, private attorney general, or consolidated proceeding. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not preside over any class, collective, representative, or private attorney general proceeding.
Jury trial waiver. To the maximum extent permitted by law, you and LitNews.ai waive any right to a jury trial for any claim or dispute arising out of or relating to the Service or these Terms.
9. Governing law
Except to the extent preempted by the Federal Arbitration Act, these Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
10. Changes
LitNews.ai may update these Terms from time to time. The updated version will become effective when posted unless a later effective date is stated.
