WASHINGTON (LN) — U.S. District Judge Timothy J. Kelly on Friday denied a motion for a preliminary injunction and dismissed a civil rights suit filed by Yi Sun against the New York Police Department and state housing officials. The order, filed in the U.S. District Court for the District of Columbia, dismissed individual defendants Evon M. Asforis, Marty Watson, Karima, and Tito, as well as the 25th Precinct of the NYPD and the New York State Division of Housing and Community Renewal.
Judge Kelly directed the Clerk of Court to close the case, noting that the order is final and appealable. The suit, filed under Civil Action No. 25-1402, sought emergency relief to stop alleged misconduct agencies and officials.
The court's accompanying Memorandum provided the legal reasoning for the denial and dismissal, though the full text of that memorandum was not included source text. Sun's attempt to secure immediate judicial intervention to halt the defendants' actions has now been rejected by the court.
The dismissal without prejudice leaves the door open for the plaintiff to refile the claims if the procedural deficiencies are cured.
