The underlying lawsuit was brought by Clarissa Gilmore against the Georgia Department of Corrections and several individual officers, including Officer Alberta W. Milton and Officer Christina Irizarry, among others. The case originated in the Southern District of Georgia.

The district court had granted summary judgment to Milton and Irizarry on qualified immunity grounds. The full Eleventh Circuit reversed that ruling in Gilmore v. Ga. Dep't of Corr., 144 F.4th 1246 (11th Cir. 2025) (en banc), and returned the matter to the panel.

The per curiam panel — Judges Rosenbaum, Newsom, and Tjoflat — issued the remand order on April 20, 2026, directing the district court to proceed consistent with the en banc opinion. The order is marked for publication.

The remand does not resolve the merits of Gilmore's civil-rights claims. Those questions now return to the district court under the legal framework established by the en banc ruling.
