PHILADELPHIA (LN) — U.S. Chief Judge Wendy Beetlestone on Friday granted in part and denied in part a motion for summary judgment in William McCann’s civil rights lawsuit against the School District of Philadelphia, dismissing statutory and constitutional claims involving privacy, disability, and retaliation while leaving a narrow set of allegations to move forward.
Beetlestone, sitting in the Eastern District of Pennsylvania, dismissed the defendants Charter Schools Office of the School District of Philadelphia and Office of School Safety entirely from the case.
The judge also dismissed McCann’s newly asserted claims, including a Monell claim against the Charter Schools Office and Office of School Safety, a right to privacy in medical information claim under 42 U.S.C. § 1983, a right to privacy claim under the Fourteenth Amendment, and a Section 504 claim under the Rehabilitation Act.
Beetlestone further dismissed McCann’s claims under the Health Insurance Portability and Accountability Act, the Pennsylvania Sunshine Act, the Pennsylvania Right to Know Act, and the Pennsylvania Whistleblower Act.
The court also granted summary judgment for individual defendants Joanna Beaver, Stefanie Ferriola, and Craig Johnson, Jr. on McCann’s claims under the Americans with Disabilities Act.
Additionally, the judge dismissed McCann’s First Amendment retaliation claims against the School District of Philadelphia and Ferriola, as well as his defamation claim against the School District, Beaver, and Johnson, Jr.
The motion for summary judgment was denied in all other respects, meaning some unspecified claims or issues remain in the case.
The case, filed as 2:24-cv-06679, continues in the Eastern District of Pennsylvania.
