Thompsongas Agrees to Conditional Certification in FLSA Overtime Suit Over Unpaid Vehicle Inspections and Training

Gahrmann alleges that Thompsongas failed to pay him and other similarly situated employees for time spent completing pre- and post-trip vehicle inspections and for company-required safety training that was performed off the clock.

The dispute centers on whether service technicians who worked over forty hours in any workweek were denied overtime wages because they were not compensated for these mandatory activities.

The parties filed a Joint Stipulation and Motion for Entry of Order Approving Conditional Certification and Proposed Notice Procedures on April 8, 2026, agreeing that the proposed class definition met the "fairly lenient standard" for conditional certification under the FLSA.

The court defined the conditional class as all service technicians who worked for Thompsongas in Florida at any time in the three years preceding the filing of the complaint, worked over forty hours in any workweek, and were not paid for the specified inspections or training.

The opinion, issued by Judge J. Eric Smith on April 20, 2026, approved the proposed Notice of Your Right to Join Case Seeking to Recover Overtime Wages for Thompsongas, LLC Service Technicians and the Consent to Join Collective Action.

Thompsongas must provide Plaintiff's counsel with a list of potential class members, including names, last known mailing addresses, and personal email addresses, in native Excel format within fourteen days.

Plaintiff's counsel will mail and email the notice and opt-in consent form to each individual at their own expense, sending a single copy via both regular mail and email.

Individuals receiving notice have sixty days from the date of mailing to return a signed Opt-In Consent Form, with verifiable electronic signatures such as DocuSign accepted.
