The order resolves the damages phase for a subset of plaintiffs in the consolidated 9/11 litigation, including the estates of James Munhall and Troy Nilsen, as well as surviving family members Susan and Lauren Munhall, Jennifer Nilsen, Scott Nilsen, and Ryan Nilsen.

The plaintiffs agreed to waive their claims for punitive damages against the Islamic Republic of Iran in exchange for the court directing the clerk to enter final judgments on their compensatory awards.

The court ordered that prejudgment interest be calculated at a rate of 4.96 percent per annum, compounded annually, for the period from September 11, 2001, until the date of the final judgment.

This order acknowledges prior partial default judgments entered by Judge Daniels in 2019 and 2020, which had awarded conscious pain and suffering, economic loss, and solatium damages to these plaintiffs.

The underlying liability against Iran was established in 2011 by Magistrate Judge Maas in the lead case Havlish, determining that Iran could be held liable to 9/11 plaintiffs under 28 U.S.C. § 1605A.

The final judgments are certified pursuant to Federal Rule of Civil Procedure 54(b).

The order notes that Burnett plaintiffs not appearing in the attached exhibits, who were not previously awarded damages, may submit applications in later stages to be approved on the same basis.
