The order, issued by Judge George B. Daniels on April 20, 2026, acknowledges that the plaintiffs identified in Exhibits B-1 through B-3 have agreed to waive their claims for punitive damages. In exchange, the court directed the Clerk of the Court to enter final judgments certifying the plaintiffs' compensatory damage awards under Federal Rule of Civil Procedure 54(b).
The plaintiffs benefiting from this order include the estates of Andrew Jordan, Vincent Morello, and Terence McShane, as well as family members such as Lisa Jordan, Kelsey Jordan, Sean Jordan, Matthew Jordan, Catherine McShane, Colin McShane, Sean McShane, Aidan McShane, Deborah Temple, Justin Morello, and Paige Morello.
These awards build upon prior partial default judgments entered by the court. In 2011, Magistrate Judge Maas determined that Iran could be held liable to 9/11 plaintiffs under 28 U.S.C. § 1605A. Subsequent orders by Judge Daniels in January and July 2022, and January 2026, awarded compensatory damages for conscious pain and suffering, solatium, and economic loss to these specific estates.
The court ordered that prejudgment interest on the compensatory damage awards be calculated by the Clerk at a rate of 4.96 percent per annum, compounded annually. This interest accrues for the period from September 11, 2001, until the date of the final judgment.
The order notes that O'Neill-Bodner plaintiffs not appearing in the attached exhibits, who were not previously awarded compensatory or punitive damages, may submit applications in later stages. These future applications will be approved on the same basis as the currently approved plaintiffs.
The litigation stems from the original complaint styled Bodner, et al. v. Islamic Republic of Iraq, filed on December 27, 2019, bearing civil action no. 1:19-cv-11776. The plaintiffs remain segregated in the consolidated In re: Tenorist Attacks on September 11, 2001 MDL proceedings under their original civil action number.
