NEW YORK (LN) — U.S. Magistrate Judge Ona T. Wang issued the order on May 15, following a discovery status conference held on May 12 for all actions in the multidistrict litigation.
The court addressed several pending discovery motions, including plaintiffs’ motion to compel further “Project Giraffe” discovery.
Wang ordered the parties to meet and confer on five specific questions regarding raw evaluation data.
The judge also directed OpenAI to log data that had been previously clawed back and to meet and confer on whether additional information could be provided concerning the clawed-back document.
Additionally, OpenAI was ordered to log evaluations that are being withheld because they post-date the litigation.
The court also addressed Microsoft’s motion for New York Times Brand Tracker Survey data, denying the motion without prejudice.
The judge directed the parties to continue meeting and conferring on the production, including efforts involving third-party firm Kantar.
A motion regarding a deposition on OpenAI’s click-through data was denied as moot, as the parties had represented that the issue was resolved.
The court also directed parties to cross-file supplemental briefs by May 15 regarding Microsoft Financials, with responses due by May 20.
The parties were instructed to discuss why production of financial information tied to LLM integration licenses is or is not a sufficient response to the request.
The clerk was directed to close several ECF numbers in Case No. 25-MD-3143, including 1506, 1513, 1518, and 1520.
