OKLAHOMA CITY (LN) — A federal judge in the Western District of Oklahoma denied a motion to dismiss filed by The Boeing Company on April 17, 2026, after plaintiff Latoya S. Miles filed an amended complaint that rendered the defendant's challenge to the original pleading moot.
The order in Case No. CIV-25-01520-JD addressed a motion filed by Boeing that challenged the sufficiency of Miles' initial complaint.
In response to the motion, Miles timely filed an amended complaint under Federal Rule of Civil Procedure 15(a)(1)(B).
The court stated that the plaintiff's amendment "supersedes the original and renders it of no legal effect," citing 10th Circuit precedent including Davis v. TXO Prod. Corp. and Predator Int'l, Inc. v. Gamo Outdoor USA, Inc.
Because the amended complaint replaced the original filing, the court determined that Boeing's motion to dismiss the superseded document was moot.
The order denied the motion as moot and without prejudice.
