SAN JOSE (LN) — U.S. District Judge P. Casey Pitts on Tuesday set a January 14, 2027 deadline for Dustin Foret to file a motion for class certification in his putative class action against Adobe Inc., following an initial case management conference.

The order, issued May 12, establishes a comprehensive schedule for the litigation, which is currently in its early stages. Foret, the named plaintiff, has until August 28, 2026, to join other parties or amend his pleadings.

Document production is due to be substantially completed by November 6, 2026. The court expects the parties to comply with presumptive limits on discovery under the Federal Rules of Civil Procedure, referring any disputes to the assigned Magistrate Judge.

If the parties cannot stipulate to an amendment, any motion to amend pleadings must be submitted by the August 28 deadline. Pitts noted that Federal Rule of Civil Procedure 15 requires the court to "freely give leave" to amend "when justice so requires" and expects parties not to "unreasonably withhold consent."

Following the class certification briefing, which includes opposition and reply deadlines extending into April 2027, fact discovery will conclude on June 24, 2027. Expert discovery is scheduled to wrap up by September 16, 2027.

The court also outlined briefing limits for potential summary judgment motions, capping plaintiff's opening briefs at 25 pages and defendant's reply briefs at 15 pages. The parties must stipulate to a briefing schedule with the final brief filed at least 21 days.

Alternative dispute resolution must be completed, and dispositive motions must be filed, by September 23, 2027. A trial setting conference is currently scheduled for February 8, 2028.

The case management order applies to the Northern District of California's standing order for civil cases, which is available through the court's website or the Clerk of the Court.

The schedule may be modified only by court order for good cause. Requests to modify deadlines must be made before the applicable deadline expires.
